State Criteria for Specific Learning Disabilities

On December 19, 2007 the Board of Regents voted to promulgate special education regulations. As part of these regulations, the Rhode Island Department of Education must establish state criteria for Specific Learning Disabilities. The Rhode Island Board of Regents for Elementary and Secondary Education Approved the State Criteria for Specific Learning Disabilities June 4, 2009. 

The new State Criteria for Specific Learning Disabilities includes a timeline which phases in the requirement to use RTI as part of the eligibility determination process beginning September 1, 2010RTI is a process of determining appropriate support and interventions to supplement the core curriculum to meet the needs of all learners. This framework for instruction bases decisions on benchmark and progress monitoring data to improve achievement.

Specific Learning Disability Criteria Waiver Information

Local Educational Agencies (LEA) may apply for a waiver to delay the requirement to use a student’s response to intervention to determine eligibility for special education as a student with a specific learning disability for up to one year as included in the criteria.

Secondary

 The RTI Project” is a community of district, school, and teacher leaders in Rhode Island who work together to improve their secondary schools through the development of a comprehensive Response to Intervention (RTI) framework.  Together, this community will develop a network of support, learn from each other and experts from the field, and facilitate change in their respective schools with aspirations to lead their district and the state as exemplars. The RTI Project will:

  • Receive on-going support to foster real change

  • Work with this community to determine how to implement RTI at the school level and commit to “learning by doing”

  • Share your knowledge, experience, and successes, as well as your obstacles

  • Reflect and problem solve collaboratively to overcome RTI implementation challenges

  • Participate in expert trainings on RTI from members and external experts

  • Leverage the talent of educational leaders in Rhode Island

  • Serve as a “model” of RTI development in Rhode Island’s secondary schools (including a variety of stages of implementation)

Apply to be a part of the RTI Project

Waiver Process - All LEAs must indicate in writing to RIDE their intention to apply for or forgo a waiver to delay the requirement to use a student’s response to intervention in determining special education eligibility under Specific Learning Disability.
RIDE Notice to Districts of Option to Apply for a Waiver for Secondary LD Identification through RTI

1. Indicate in writing, using the form below whether or not LEA intends to apply for the waiver by April 4, 2011

2. If an LEA is applying for the waiver,
    a. submit a letter from the Superintendent  along with
    b. the completed RI RtI Implementation Self Assessment and comprehensive action plan in its entirety by May 6, 2011

Elementary

Each LEA applying for a waiver to delay the requirement to use a student’s response to intervention and extend the ability to use severe discrepancy at the elementary school level must submit a letter from the superintendent by May 14, 2010.  In addition, LEAs must include with their request a completed RI RTI Implementation Self- Assessment checklist including a comprehensive action plan to enable the district to meet the requirements in elementary schools by September 1, 2011.
